CONDITIONS DE RÉSERVATION, DE PAIEMENT et D'ANNULATION

Concernant les modalités de réservation auprès de Jolly Roger Sailing (ci-après dénommée : JRS), les conditions de réservation, de paiement et d’annulation suivantes s’appliqueront :

a. Qualifications de l’affréteur

Si vous choisissez une location sans équipage, JRS (ainsi que la législation grecque) exige qu’au moins deux membres d’équipage aient des compétences de navigation adéquates. Cela peut être vérifié par une licence/certificat de navigation approprié pour les deux membres d’équipage ou, dans le cas où un seul membre détient une licence de skipper valide, le co-skipper peut fournir une autre preuve de compétence de navigation ou signer une déclaration de compétence de navigation. Les documents ci-dessus sont exigés par les autorités portuaires et doivent être présentés le jour de votre enregistrement (une procédure effectuée par JRS). Sinon, les autorités portuaires n’autoriseront pas le départ du bateau. De plus, les autorités portuaires demandent que les licences soient en anglais ou officiellement traduites en anglais, et bien sûr, qu’elles n’aient pas expiré. Certaines licences, telles que les certificats Day Skipper, les licences de yacht à moteur ou celles avec des limitations différentes, peuvent ne pas être acceptées par les autorités portuaires. Pour cette raison, il serait préférable de nous envoyer une copie de votre permis avant votre arrivée, afin de s’assurer qu’il est conforme à ce qui est demandé.

b. Procédures de réservation / Conditions de paiement

Sur notre site Web, vous pouvez vérifier les dates disponibles à la demande. Une fois que vous avez décidé de réserver une date libre, vous pouvez en faire la demande soit : a) via notre site Web, b) par e-mail, ou c) directement en appelant notre responsable des réservations (les coordonnées sont également fournies sur notre site Web ). Votre demande sera conservée pour vous en tant qu’option de demande en attente pendant 48 heures. Dans ce délai, vous devrez confirmer votre intérêt par e-mail ou par téléphone, et notre responsable des réservations vous contactera pour plus de détails. Si vous avez besoin de plus de jours pour vous décider, veuillez contacter notre responsable des réservations. Vous recevrez ensuite un contrat de réservation avec les détails de la location ainsi que des informations concernant le paiement. La date vous sera réservée lorsque vous aurez renvoyé le contrat de réservation signé et versé un acompte de 50% du prix total. Dans le cas contraire, la date sera proposée à la prochaine demande en attente. Pour pallier tout problème résultant d’éventuels retards de virement bancaire, vous pouvez nous envoyer une preuve de paiement par e-mail et la date vous sera automatiquement réservée. Le paiement du solde restant de 50% du prix total doit être effectué au plus tard 40 jours avant votre date d’enregistrement. En cas de réservation effectuée dans les 39 jours à compter de la date d’arrivée, la somme complète doit être versée. Sur demande de votre part, des factures officielles vous seront envoyées pour tous les paiements au plus tard trois jours ouvrables après votre dépôt. Notez que les paiements ci-dessus se réfèrent au coût du trajet et non au coût des services supplémentaires que vous pourriez avoir demandés, ou du dépôt de garantie, qui seront tous payés à notre base avant votre embarquement. Le cas échéant, l’affréteur est également responsable d’informer JRS de tout changement dans la composition de l’équipage. c. Procédure d’enregistrement / de départ Toutes les locations commencent le samedi à 17h00 à notre base. Avant l’embarquement, notre Chef de Base fera visiter le bateau au skipper et au co-skipper et répondra également à leurs éventuelles questions techniques. Si les horaires de vol ne permettent pas une arrivée à l’heure au port, un enregistrement tardif est possible jusqu’à 19h00. Dans un tel cas, nous devons être prévenus à l’avance. Si vous arrivez encore plus tard, notre Chef de Base peut vous attendre au port jusqu’à 21h00 et il vous installera dans le bateau mais il n’y aura pas de procédure d’enregistrement ce jour-là. Dans ce cas, l’enregistrement commencera le lendemain matin entre 08h30 et 09h00, et une fois toutes les procédures terminées, vous serez prêts à partir. Le bateau vous sera livré avec les réservoirs d’eau et de carburant pleins, ainsi que le réservoir du moteur hors-bord plein. Le départ s’effectue également le samedi à 09h00, mais vous devez être de retour au port de base le vendredi au plus tard à 17h00, sauf accord contraire. Lors du check-out, le bateau sera inspecté par le Chef de Base et par un plongeur, et après avoir rempli les réservoirs d’eau et de carburant en votre présence, votre dépôt de garantie vous sera restitué. Veuillez garder à l’esprit que l’affréteur prend également en charge le coût du nettoyage final.

d. Conditions d’annulation

Toute modification des dates réservées est considérée comme une annulation et, selon la date, est soumise aux frais suivants :
i. Annulation due à la négligence de l’affréteur :
Un à 40 jours avant la date d’enregistrement, 100 % du tarif de location déposé sera retenu. 41 à 60 jours avant l’enregistrement prévu, l’acompte sera retenu. Pour les annulations effectuées plus de 60 jours avant la date d’enregistrement, 30% du tarif total sera retenu et le montant restant de l’acompte sera remboursé. Cependant, si le yacht est réservé pour la période annulée par un autre client, la somme déposée sera intégralement restituée, à l’exception de frais de dossier de 300 € qui seront retenus.
ii. Annulation due à des événements imprévisibles
Dans le cas où des événements imprévisibles auraient entraîné l’annulation de la location réservée par l’affréteur (par exemple, interdictions de voyager, restrictions aux frontières, annulations de vols), JRS conservera la somme déposée comme acompte pour une autre location, que le client a droit d’effectuer dans les 18 mois à compter de la date de location annulée. L’affréteur devra choisir une location de la même catégorie tarifaire, faute de quoi un solde sera nécessaire pour compenser la différence. Dans tous les cas, cela peut être arrangé avec notre responsable des réservations, qui vous conseillera au mieux de vos intérêts.
iii. Annulation du fait de la responsabilité de la société
Dans le cas extrême où le bateau ne serait pas disponible à votre arrivée en raison de graves dommages causés lors de la location précédente, JRS couvrira les frais d’hôtel dans le port de base pendant deux jours maximum, étant donné que le bateau peut être réparé dans ce délai. . Sinon, JRS s’engage à vous trouver un autre bateau de la même catégorie ou d’une catégorie supérieure en matière de nombre de cabines/toilettes, et dans un tel cas, le coût supplémentaire sera couvert par notre société. Si rien de ce qui précède n’est possible, JRS remboursera intégralement la somme déposée et vos frais d’hébergement seront couverts pour la période réservée. JRS se réserve le droit d’annuler une location sans aucun remboursement si l’affréteur ne respecte pas les conditions décrites dans le contrat signé entre l’affréteur et la société.Responsabilité civile et assurance de location JRS a assuré les bateaux de la société conformément à la loi grecque, contre les risques découlant de la responsabilité envers les tiers et des dommages accidentels à la coque, aux machines et à l’équipement au-delà du dépôt de garantie remboursable. Cependant, la responsabilité de l’affréteur ne se limite pas au dépôt de garantie en cas d’incident causé par un manque grave de compétences en navigation, une grande négligence ou intentionnellement. Nous vous recommandons vivement de souscrire à une assurance voyage pour couvrir les dépôts non remboursables au cas où vous auriez besoin d’annuler votre réservation pour une raison imprévue. Assurez-vous d’avoir une assurance voyage personnelle qui couvre la navigation.

Invoicing / financial information

In case you purchase any of our services / products, we will keep in our database the information necessary for the invoicing, such as name, address, email, phone number, vat id, etc. We will contact you in cases involving payment of services / products, invoice balances, recurring charges, offers about our products etc, via e-mail, sms or by phone. All data transferred via email is protected by a TLS / SSL security protocol.

Website traffic monitoring

Like most sites, this site uses Google Analytics (GA) to track user activity. We use this data to determine the number of our site visitors to better understand how they find and use our web pages. Although GA records data such as your geographic location, your device, your web browser, and your operating system, none of this information identify you to us. GA also records your computer’s IP address, which could be used to identify you, but Google does not provide access to it. About this site’s web server

All web traffic (file transfer) between this site and your browser is encrypted and transferred via the HTTPS protocol using Secure Sockets Layer (SSL). Our servers, in order to ensure the smooth and secure operation of our services, record the user’s ip and, in case of failed connections, the username, in log files through security systems (firewalls, ddos filters, http filters, sql injection filters, visit statistics, cloudflare services) and backup. BOOKING, PAYMENT & CANCELLATION TERMS

Please be informed that the Terms and Conditions described in this website are subject to changes. We encourage our customers to contact our Reservation Manager (via e-mail or telephone, as described on our website) for an update in case such changes have taken place. He will also be happy to answer any other questions you may have regarding the Company, our policy, the procedures described in our website, and anything else regarding your holiday.

Regarding the booking procedures with Jolly Roger Sailing (hereafter: JRS), the following Booking, Payment and Cancellation Terms will apply:

a. Charterer’s qualifications

If you choose a Bareboat charter, it is required by JRS (as well as Greek legislation) that at least two crew members have adequate sailing competency. This can be verified by the appropriate sailing licence/certificate for the two crew members or, in case only one member holds a valid Skipper licence, the co-skipper can provide other proof of sailing competency, or sign a declaration of sailing competency.

The above documents are required by the port authorities and should be produced on the day of your check-in (a procedure carried out by JRS). Failling to do so, the port authorities will not permit the boat to depart. Furthermore, the port authorities request that the licences be in English or officially translated to English, and of course, that they have not expired.

Certain licences, such as Day Skipper certificates, motor yacht licences or those with different limitations, may not be accepted by the Port Authorities. For this reason, it would be best to send us a copy of your licence before your arrival, in order to make sure they are as requested.

b. Booking Procedures / Terms of Payment

On our website you can check the dates open for request. Once you have decided to reserve an open date, you can claim it as a request either: a) through our website, b) by e-mail, or c) directly by calling our Reservation Manager (contact details are also provided on our website).

Your request will be held for you as a pending request option for 48 hours. Within this period you will have to verify your interest by e-mail or phone, and our Reservation Manager will contact you for further details. If you need more days to decide, please contact our Reservation Manager. Next, you will be sent a booking contract with the charter details as well as information regarding payment. The date will be reserved for you when you have returned the signed booking contract and have wired a down payment equal to 50% of the total fare. Otherwise, the date will be offered to the next waiting claim. To overcome any problems resulting from possible bank transfer delays, you can send us proof of payment via e-mail and the date will be automatically reserved for you.

The remaining balance payment of 50% of the total fare must be wired 40 days before your check-in date at the latest. In case of a reservation made within 39 days from the check-in date, the full fare should be deposited.

For all payments, formal invoices will be sent to your mailbox three working days after your deposit at the latest, upon your request.

Keep in mind that the above payments refer to the cost of the fare and not the cost of any extra services you may have requested, or the security deposit, all of which will be paid at the Base before your embarkation.

The charterer is also responsible for notifying JRS of any changes in the crew composition should they occur.

c. Check-in / Check-out Procedure

All charters begin on Saturday at 17:00 at our Base. Before embarkation, the skipper and the co-skipper will be given a tour of the boat by our Base Manager, who will also answer any technical questions they may have. In case flight schedules do not allow for an on-time arrival at the port, a late check-in is possible until 19:00. In such a case, we must be notified in advance. Should you arrive even later, our Base Manager can wait for you at the port until 21:00 and he will accommodate you in the boat but there will be no check-in procedure on this day. In this case, check-in will commence the next morning between 08:30 and 09:00, and after all procedures are completed you will be ready to depart. The boat will be delivered to you with full water and fuel tanks, as well as full outboard engine tank.

Check-out is carried out also on Saturday at 09:00, but you are expected to be back to the Base port on Friday at the latest by 17:00, unless otherwise agreed. During check-out, the boat will be inspected by the Base Manager and by a diver, and after refilling the water and fuel tanks in your presence, your security deposit will be returned. Please keep in mind that the Charterer also bears the cost of the end-cleaning.

d. Cancellation Terms

Any change to the dates that have been booked is considered a cancellation and, depending on the date, is subject to the following fees:

i. Cancellation due to charterer’s negligence:

One to 40 days prior to the check-in date, 100% of the deposited charter fare will be withheld.
41 to 60 days prior to the scheduled check-in, the advance payment will be withheld.
For cancellations made more than 60 days prior to the check-in date, 30% of the total fare will be withheld and the remaining amount of the advance payment will be reimbursed.
However, if the yacht is booked for the cancelled period by another customer, the deposited fare will be returned in full, except for an administration fee of 300€ which will be withheld.

ii. Cancellation due to unforeseeable events

In the event unpredictable events have resulted in the cancellation of the booked charter by the Charterer (e.g., travel bans, border restrictions, flight cancellations), JRS will keep the deposited fare as an advance payment for another charter, which the customer is entitled to take within 18 months from the cancelled charter date. The Charterer will have to choose a charter of the same fare category, otherwise a balance payment will be necessary to compensate for the difference. In any case, this can be arranged with our Reservation Manager, who will advise you according to your best interests.

iii. Cancellation due to the company’s responsibility

In the extreme case where the vessel will not be available upon your arrival due to severe damage done during the previous charter, JRS will cover hotel expenses in the Base port for up to two days, given that the boat can be repaired in this time frame. Otherwise, JRS takes the responsibility to find another vessel for you of the same or higher category regarding the number of cabins/heads, and in such a case, the additional cost will be covered by the Company. If none of the above is possible, JRS will refund the deposited fare in full and accommodation expenses will be covered for the booked period.

JRS reserves the right to cancel a charter without any fare reimbursement if the Charterer does not comply with the terms described in the contract signed between the Charterer and the Company.

Third Party Liability and Charter Insurance

JRS has the company boat insured according to Greek law, against risks arising from liability to third parties and accidental damage to the hull, machinery, and equipment in excess of the refundable security deposit. However, the Charterer’s liability is not limited to the security deposit in case of an incident caused by a severe lack of sailing skills, great negligence or intention.

We highly recommend you arrange travel insurance to cover non-refundable deposits in case you need to cancel your booking for an unexpected reason. Please make sure you have personal travel insurance that covers sailing.
